How to Start a Short-Term Rental Business in Yarmouth

A compliant STR setup requires zoning confirmation, annual registration through the Yarmouth Health Department, and operational readiness to meet health, safety, parking, and occupancy standards.

  1. Confirm Zoning Eligibility

    • Verify that the subject property lies within a zoning district that allows STRs by-right (see “Specific Regulations” below).
    • Confirm the unit is not ineligible (income-restricted housing, accessory apartments, or dwellings with outstanding code violations).
    • Confirm that the unit is served by adequate water and wastewater disposal and meets applicable building and fire codes.
  2. Annual Registration and Compliance

    • Register annually with the Yarmouth Health Department as required by General Bylaw Chapter 108—Occupancy of Buildings.
    • Obtain and post the rental certificate in a prominent location inside the unit, including a 24-hour local contact.
    • Post the property’s E-911 address or other specific location information inside the unit to aid guest and emergency response orientation.
  3. Operational Setup

    • Establish occupancy limits based on Health Department inspections and bedroom count.
    • Provide adequate on-site parking: minimum one space per bedroom; no parking on lawns; no overnight street parking; no parking that impedes traffic or emergency access.
    • Implement trash removal: all household trash must be removed immediately after occupancy ends and at minimum once per week.
    • Enforce quiet hours and neighborhood-friendly practices; STRs must not adversely affect the residential character of the neighborhood or interfere with neighbors’ reasonable enjoyment of their residence.
  4. Listing and Guest Policies

    • Listings and bookings must reflect residential use only (no large-scale events such as weddings, corporate events, reunions, or photo shoots; no events with tents or amplified music).
    • No use of RVs, campers, or sleeping tents on the property.
    • Rentals of less than two consecutive nights are prohibited.
    • Ensure pets comply with all applicable state and local regulations.
  5. Renewals and Inspections

    • Renew annual registration and keep all certificates and posted information current.
    • Address any new building, sanitary, zoning, or fire code violations promptly to maintain eligibility.
    • Maintain 24-hour local contact availability for guests, neighbors, and the Town.

Required Documents, Permits, Licenses, and Guidelines

  • Annual Registration (Health Department): Required under General Bylaw Chapter 108—Occupancy of Buildings.
  • Rental Certificate: Displayed on the property in a prominent location; must include 24-hour local contact information.
  • Compliance Documentation: Evidence of compliance with building, fire, health, water, and wastewater codes; occupancy limitations established via inspection; E-911 address posted inside the unit.
  • Zoning Confirmation: Proof that the property is located in a zoning district where STRs are allowed by-right and that the unit is not ineligible.
  • Parking and Trash Plans: Documentation or procedures demonstrating on-site parking capacity (minimum one space per bedroom) and solid waste management (minimum once per week and post-occupancy removal).

Note: The Town’s “Rental Dwelling Registration” page indicates the Town does not require registration for short-term or long-term rentals. However, the Zoning Bylaw explicitly requires annual registration through the Yarmouth Health Department and adherence to health and safety requirements. Investors should follow the zoning bylaw’s registration mandate and verify process details with the Town.

Overview of Yarmouth

Yarmouth is a town in Cumberland County, Maine, United States, twelve miles north of the state's largest city, Portland. When originally settled in 1636, as North Yarmouth, it was part of the Massachusetts Bay Colony, and remained part of its subsequent incarnations for 213 years. In 1849, twenty-nine years after Maine's admittance to the Union as the twenty-third state, it was incorporated as the Town of Yarmouth. Yarmouth is part of the Portland–South Portland–Biddeford Metropolitan Statistical Area. The town's population was 8,990 in the 2020 census. The town's proximity to the Atlantic Ocean, and its location on the banks of the Royal River (formerly Yarmouth River), which empties into Casco Bay less than 1 mile (1.6 km) away, means it is a prime location as a harbor. Ships were built in Yarmouth's harbor mainly between 1818 and the 1870s, at which point demand declined dramatically. Meanwhile, the Royal River's four waterfalls within Yarmouth, whose Main Street sits about 90 feet (27 m) above sea level, resulted in the foundation of almost sixty mills between 1674 and 1931. The annual Yarmouth Clam Festival attracts around 80,000 people (around ten times the town’s population) over the course of the three-day weekend.
