STR Regulations for Lewiston, Maine

Overview: Are STRs allowed in Lewiston, ME?

  • Yes. Short‑term rentals are allowed in Lewiston, Maine. As of the content reviewed, Lewiston has not enacted city‑specific STR licensing or registration requirements. State‑level Maine rules still apply, including the statewide STR registration program and a 9% Vacation (Casual) Rental Tax collected from guests.

How to start a short-term rental business in Lewiston

  • Validate zoning and land-use permissions before acquisition or conversion.
    • Confirm that your intended use as a short‑term rental is permitted in the property’s zone under Appendix A (Zoning and Land Use Codes). The City’s lodging‑house ordinance defines “lodging place” (including hotels, inns, motels, lodging houses, tourist homes, and bed & breakfasts) and explicitly excludes “vacation rentals” from that definition (Ord. No. 23‑21, Chapter 22, Article XVII).
    • If you plan to operate a lodging‑house‑type business, obtain the required city lodging‑house license and pass inspections per Chapter 22, Article XVII; do not rely on vacation‑rental classification to avoid lodging‑house licensure.
  • Complete Maine’s statewide STR registration and tax setup.
    • Register each STR unit with the State of Maine as required (effective 2024). This program establishes a unique identifier for each STR and enables tax compliance tracking.
    • Collect and remit the 9% Vacation (Casual) Rental Tax on all bookings (with state‑defined exemptions).
    • Open a separate bank account and accounting system for the STR business; maintain detailed records (income, expenses, guest stays, communications).
  • Safety and habitability readiness.
    • While Lewiston has no city‑specific STR safety inspection program in the reviewed sources, follow best practices aligned with the International Property Maintenance Code and NFPA standards referenced in the lodging‑house ordinance. This includes smoke and carbon‑monoxide detectors, fire extinguishers, clear egress, and safe electrical/plumbing systems.
  • Operating plan and community relations.
    • Develop house rules (occupancy, quiet hours, parking, trash), guest screening protocols, and local contact procedures.
    • Maintain guest registers and departure records if operating a lodging‑house (not required for vacation rentals).
    • Be responsive to neighbors and city officials; address complaints promptly to avoid enforcement under general ordinances.

Required documents, permits, licenses, and guidelines

  • State-level (required for all STRs in Maine)
    • Maine STR Registration: State registration number for each unit (unique identifier per the statewide STR program effective 2024).
    • Maine Revenue Services setup: Enrollment to collect and remit the 9% Vacation (Casual) Rental Tax (with defined exemptions).
    • Maine DECD Lodging Licensing (when applicable): If your operation meets the state’s definition of a “lodging establishment,” follow state licensing guidance.
  • City-level (Lewiston-specific)
    • Zoning verification: Confirm STR use is permissible under Lewiston’s zoning (Appendix A).
    • Vacation rentals vs lodging houses: If you are a vacation rental, you are excluded from Lewiston’s lodging‑house licensing. If you are a lodging‑house‑type business, obtain the Lewiston lodging‑house license and comply with Chapter 22 inspections and recordkeeping.
    • Lodging‑house license (if applicable): Submit a complete application to the City Clerk, designate Legal Owner, Business Operator, Property Manager, and Emergency Contact; pass required inspections; renew annually per city schedule.
  • Documentation to maintain
    • Property ownership or lease evidence; floor plans and occupancy limits.
    • Local contact information and 24/7 response procedures (best practice).
    • Insurance: While not mandated for STRs in the reviewed city sources, maintain liability coverage appropriate for your risk profile and lender/partner requirements.
    • Financial records: Tax returns, lodging‑tax filings, and transaction histories.
    • If operating as a lodging house: Guest register and departure records (retained for 2 years).

Overview of Lewiston

Lewiston (; French: [luistɔ̃]) is the second most populous city in the U.S. state of Maine, with the city's population at 37,121 as of the 2020 United States Census. It is the county seat of Androscoggin County. The city lies halfway between Augusta, the state's capital, and Portland, the state's most populous city. It is one-half of the Lewiston-Auburn Metropolitan Statistical Area, commonly referred to as "L/A." or "L-A." Lewiston exerts a significant impact upon the diversity, religious variety, commerce, education, and economic power of Maine. It is known for having an overall low cost of living, substantial access to medical care, and a low violent-crime rate. In recent years, the city of Lewiston has also seen a spike in economic and social growth. While the dominant language spoken in the city is English, it is home to a significant Somali population as well as the largest French-speaking population in the United States (by population) while it is second to St. Martin Parish, Louisiana, in percentage of speakers. The Lewiston area traces its roots to 1669 with the early presence of the Androscoggin tribe (the namesake of the county in which the city resides). In the late 18th century, in 1795, Lewiston was incorporated as Lewistown. The presence of the Androscoggin River and Lewistown Falls made the town an attractive area for manufacturing and hydro-power businesses. The rise of Boston rail and textile tycoon Benjamin Bates saw rapid economic growth rivaling that of Cambridge, Worcester, and Concord. Irish immigrants were recruited to build the railroad links and dig the canals for the textile mills. The Irish stayed, and worked the mills and established flourishing businesses, as evidenced by the McGillicuddy, Callahan, and other Blocks and the St. Joseph's and St. Patrick's churches. In the 1850 U.S. Census, Lewiston was 23% Irish born. The increase in economic stimulus prompted thousands of Quebecers to migrate, causing a population boom; the populace rose from 1,801 in 1840 to 21,701 in 1890. In 1855, local preacher Oren Burbank Cheney founded the Maine State Seminary, the first coeducational university in New England and one of the first universities to admit black students before the Emancipation Proclamation. Lewistown quickly became associated with the liberal arts and was incorporated as "Lewiston" in 1864, a year before the college was chartered as Bates College. The city is home to the only basilica in Maine, Basilica of Saints Peter and Paul; 5 colleges and universities; 44 listings on the National Register of Historic Places; the Androscoggin Bank Colisée; the Stephens Observatory; the Olin Arts Center; the Bates College Museum of Art (BCMoA); and two significant general hospitals: Central Maine Medical Center and Saint Mary's Regional Medical Center.
