STR Regulations for Hyde Park, Massachusetts

Overview: Are STRs allowed?

  • Short-term rentals are allowed in Hyde Park, MA, which is a neighborhood of the City of Boston. STRs must comply with the City of Boston’s Short-Term Rental Ordinance and related state laws. Key points:
    • Owner-occupied units (or a unit where the registrant lives in the building) may operate subject to limits and requirements.
    • Investor-owned units are permitted but have stricter caps and limitations.
    • All STRs must register with the City of Boston and display a valid registration number on listings.
    • Compliance includes safety and habitability standards, insurance, taxation, and annual reporting.

How to start a STR business in Hyde Park

  • Confirm eligibility and category:
    • Owner-occupied: you live in the unit or building as your primary residence.
    • Investor-owned: you do not live in the unit/building.
  • Register the unit and all listings with the City of Boston (Boston’s Inspectional Services Department/Boston 311 handles registration and compliance).
  • Comply with state lodging laws and fire-safety rules (e.g., posting egress plans, smoke/CO alarms).
  • Maintain insurance as required by the Boston ordinance and your hosting platform’s policies.
  • Collect and remit Boston’s lodging taxes and state excise taxes on short-term rentals.
  • Meet local housing standards (lead-safe for pre-1978 units, rodent control, waste management).
  • For multi-unit buildings: check condo/HOA rules—many associations prohibit transient rentals.
  • Keep records of reservations, guest screening logs, and tax filings for annual reporting.
  • Display your Boston STR registration number prominently on all listings.

Required documents, permits, licenses, and guidelines

  • City-level (Boston):
    • STR registration: registration application, proof of ownership/occupancy, property details, compliance attestation.
    • Lodging tax registration and monthly remittance (City of Boston room-occupancy excise).
    • Annual STR reporting (occupancy days, gross rental receipts, platform fees).
    • Lead paint disclosure/Compliance for pre-1978 units; any health/safety certifications as applicable.
  • State-level (Massachusetts):
    • Lodging License (MGL c. 140, §§ 23–27): proof of compliance (inspection for fire safety, egress, health rules), insurance.
    • State rooms excise tax registration and monthly remittance (generally 5.7% plus any local add-ons).
    • If offering meals, a food-service permit may be required.
  • Platform-side:
    • STR platform compliance (e.g., Airbnb registration requirements, host verification, tax reporting support).

Specific STR regulations

  • City of Boston STR Ordinance:
    • Registration required; registration number must appear on listings.
    • Owner-occupied listings may be subject to limits on number of units, maximum stay caps (often less than 28 days), and annual hosting caps.
    • Investor-owned units are subject to stricter caps on allowable rental days and tighter restrictions on listings/operations.
    • Annual reporting and record-keeping (reservations, days occupied, gross receipts, platform fees).
    • Safety requirements (posting egress plans, functioning smoke and carbon monoxide alarms).
    • Taxation: Boston lodging tax plus Massachusetts state rooms excise tax; taxes must be collected and remitted.
    • Anti-nuisance and enforcement: violations can result in fines, platform takedowns, and loss of registration.
    • Note: The City of Boston adopted and later strengthened the STR ordinance; Hyde Park follows the same framework.
  • State of Massachusetts:
    • Lodging License: inspections by the local licensing authority for fire safety, egress, health and habitability standards.
    • Rooms excise tax: 5.7% on the total price of the room (including fees) for stays under 28 days; monthly remittance.
    • Local options: certain municipalities may add a local room-occupancy tax; Boston imposes an additional lodging tax.
    • Compliance with state landlord-tenant and consumer protection laws.
  • County-level:
    • No separate Norfolk County STR licensing for Hyde Park; STRs are governed by Boston’s city ordinance and Massachusetts state law.

Practical notes for investors

  • Do a pre-purchase check: confirm condo/HOA rules on short-term rentals and building insurance.
  • Understand Boston’s “28-day” rule context: the City’s rules shape how investor-owned units can be used; the 28-day threshold is tied to state lodging and tax definitions.
  • Keep accurate records: the City requires annual reporting of days occupied and gross receipts; platforms often transmit this data, but you must verify completeness.
  • Enforcement and appeals: the City can suspend or revoke registrations for violations; Boston 311 is the intake for complaints.

Overview of Hyde Park

Hyde Park is the southernmost neighborhood of Boston, Massachusetts, United States. Situated 7.9 miles south of downtown Boston, it is home to a diverse range of people, housing types and social groups. It is an urban location with suburban characteristics. Hyde Park is covered by Boston Police Department District E-18 located in Cleary Square, and the Boston Fire Department station on Fairmount Avenue is the quarters of Ladder Company 28 & Engine Company 48. The George Wright Golf Course, named for Baseball Hall of Fame and Boston Red Stockings shortstop George Wright, is in Hyde Park and Roslindale. It is a Donald Ross–designed course and is considered one of his finest designs. Hyde Park has taken the motto "A Small Town in the City" because of its suburban feel. The area was established in the 1660s and grew into a hub of paper and cotton manufacturing in the eighteenth century. The extension of rail lines from Boston in the 1850s spurred the area's residential development. The Readville section of Hyde Park contained a large manufacturing base housing the massive operations of the B. F. Sturtevant Company and the New York, New Haven & Hartford Railroad Locomotive and Car Shops. Hyde Park and some of its residents have been important part of societal change in the United States. It was once home to the first all African-American army unit, the 54th Massachusetts Infantry Regiment. The regiment was made famous in the movie Glory. Hyde Park was home to the prominent abolitionists the Grimké sisters, Sarah and Angelina, as well as Theodore Dwight Weld, for whom Weld Hall in Hyde Park is named.
