Short-term rentals (STRs) are regulated at the county level on Kauaʻi. The County of Kauaʻi allows two categories of legal transient vacation rentals: (1) visitor destination area (VDA) operations, which are permitted by zoning and require a zoning permit/registration; and (2) nonconforming use (NCU) operations that were lawfully established prior to July 31, 2009, and are renewed annually. Outside of VDAs and without an NCU certificate, STR use is prohibited in residential neighborhoods.
In practical terms, most of the residential areas in Hanalei are not within a designated VDA and are not zoned to permit STR use. As a result, STR operations are generally not allowed in standard residential neighborhoods in Hanalei unless the property qualifies as an NCU (i.e., it was legally operating as a TVR before July 31, 2009, and maintains current NCU renewals).
