How to Start a Short‑Term Rental Business in Toluca Lake

  1. Confirm eligibility
  • Use the property as your primary residence (reside there for at least six months of the year).
  • Obtain written landlord consent if you are a tenant (and your lease allows subletting).
  • Confirm the property is not subject to the RSO. If it is, you cannot use it for home‑sharing.
  1. Register for Transient Occupancy Tax (TOT) before listing
  • File a Transient Occupancy Registration Certificate with the Los Angeles Office of Finance (or list exclusively on a hosting platform that has a platform agreement with the City, in which case the platform collects/remits TOT for you).
  1. Apply for a Home‑Sharing registration
  • Complete the City’s online home‑sharing registration; you will:
    • Provide identity and residency proof.
    • Upload documentation (e.g., driver’s license, utility bills) confirming primary residency.
    • Sign an affidavit pledging compliance with the ordinance.
  • Maintain records of stays and make them available for inspection for three years.
  1. Prepare and operate responsibly
  • Comply with the 120‑day cap per calendar year.
  • No multiple concurrent bookings at the same address.
  • Do not advertise without including your registration number.
  • Provide and maintain required safety equipment (see “Required Safety Equipment” below).
  • Post a guest code of conduct (covers behavior, quiet hours, and local rules).
  • Collect and remit TOT or rely on a platform’s collection agreement.
  1. Consider extended home‑sharing (optional)
  • If you wish to exceed 120 days (up to 240 days), apply for extended home‑sharing:
    • Administrative clearance: available if you have no verified nuisance violations in the last three years, notify adjacent/aboring neighbors, and meet service requirements.
    • Discretionary permit: required if you have nuisance violations or do not qualify administratively; includes findings and possible conditions; appeals go to the Area Planning Commission.
  1. Monitor compliance and renew annually
  • Renew your home‑sharing registration annually; show proof of compliance and provide stay records (unless using a platform with a platform agreement).
  • Violations may trigger citations, suspension, or revocation.

Required Documents, Permits, Licenses, and Safety Equipment

  • Identity and residency proof (two documents, such as driver’s license, utility bills, tax returns, bank statements, voter registration, or car registration).
  • Written landlord consent (if renting).
  • Property documentation and basic details (address, unit type).
  • Transient Occupancy Registration Certificate (or platform agreement via your hosting platform).
  • Guest code of conduct (provided to guests).
  • Safety equipment and disclosures:
    • Fire extinguisher(s).
    • Smoke detectors.
    • Carbon monoxide detectors where required.
    • Emergency exit routes and emergency contact information posted inside the unit.
  • For extended home‑sharing: neighbor notification materials and proof of nuisance‑free record (for administrative path).

Application fee (regular home‑sharing): $89 (annual registration). Extended home‑sharing fees:

  • Administrative clearance: approximately $1,149 (plus notification costs).
  • Discretionary permit: approximately $5,660.
  • A per‑night fee was studied ($5 per night); final fee amounts require formal action by the City and may be adjusted.

  • Primary residence requirement.
  • Annual 120‑day cap on short‑term rental activity.
  • Up to 240 days possible via extended home‑sharing (administrative or discretionary review).
  • Annual registration and renewal required.
  • Complete prohibition on home‑sharing in RSO units.

  • No multiple concurrent bookings at the same property.
  • No short‑term rentals in areas or units not approved for residential habitation (e.g., storage sheds, garages, vehicles, tents).
  • Advertising requirements:
    • List your registration number in every ad.
    • Platforms must not complete bookings for unregistered listings.
  • Hosting platform obligations:
    • Provide monthly data to the City: listing addresses, nights booked, and amounts paid for each stay.
    • $1,000/day fines for: booking illegal listings; refusing to provide unregistered listing addresses upon formal request; refusing to submit required monthly documents.
    • Platforms can enter “platform agreements” enabling TOT collection and streamlined registration/renewal for hosts who list exclusively on such platforms.
  • Nuisance enforcement and penalties:
    • Verified citations (from DBS, HCID, LAPD, LAFD, or Administrative Citation Enforcement) can suspend or revoke home‑sharing privileges.
    • “Loud and unruly gathering” violations trigger a 30‑day suspension from home‑sharing; a single verified violation disqualifies a property from extended home‑sharing; two verified citations result in immediate revocation and a one‑year ban from home‑sharing.
    • Fire safety rules in Very High Fire Hazard Severity Zones include posting “no smoking” notices on patios/decks.
  • Transient Occupancy Residential Structures (TORS):
    • Conversions of existing residential buildings to TORS are restricted; new TORS must be approved via Conditional Use Permit (CUP); certain by‑right allowances for TORS in commercial zones are removed to require CUPs.

    • Weddings and evening outdoor gatherings of more than eight people (excluding children) are prohibited.
  • Administrative process:
    • The City aims to provide a streamlined online registration and renewal system; a 24/7 hotline exists for reporting non‑emergency issues and enabling real‑time host outreach.
    • A Short‑Term Rental Task Force coordinates enforcement across City agencies.

County and State Regulations (California)

  • Los Angeles County: No separate STR permitting regime beyond the City’s Home‑Sharing Ordinance for Toluca Lake. County rules do not apply to neighborhood STRs in this location.
  • California state rules relevant to your operation:
    • Transient Occupancy Tax (TOT) collection: As of recent legislation, short‑term rental platforms are required to collect and remit TOT (and potentially other local transient taxes) on bookings in California. You should still maintain TOT records; listing exclusively on a compliant platform can satisfy your collection/remittance obligations in most cases.
    • Platform cooperation and reporting: Many California jurisdictions require platforms to share listing and booking data to support enforcement. Los Angeles requires platform data sharing and prohibits platforms from completing bookings for unregistered listings.
    • Accessibility and life‑safety: Units used for short‑term rentals must meet basic fire and building safety standards for residential habitation; do not operate habitable space in non‑approved structures (garages, sheds, tents).
    • County or regional overlays (e.g., fire severity zones): If your property lies within a Very High Fire Hazard Severity Zone, you must post “no smoking” notices on outdoor areas (as noted above).

Overview of Toluca Lake

Toluca Lake is a neighborhood in the city of Los Angeles, California, located in the San Fernando Valley 12 miles (19 km) northwest of downtown. The name is also given to a private natural lake fed by wells and maintained by neighboring property owners. Prior to the paving of the Los Angeles River in 1938 and L.A. well extraction in the late 19th and 20th century which lowered the water table, Toluca Lake was fed by artesian springs. The history of Toluca Lake can be traced to the days of the Tongva Indians, followed by Spanish colonization and Mexican independence. Toluca Lake was part of the early rancho system. The original Toluca Lake was divided, with the neighborhood being known as Forman Toluca Ranch. In 1923, investors bought and developed the land as "Toluca Lake Park". The neighborhood has had notable residents. Comedian Bob Hope was a longtime resident of Toluca Lake, as were Audie Murphy and Jonathan Winters. Legendary film composer Erich Wolfgang Korngold lived there from 1938 to 1957, right on the lake. Famed actress Bette Davis built a house there. Bing Crosby had a house later owned by Andy Griffith and Jerry Van Dyke. Phil Everly, Mary Astor, and Frank Sinatra also had houses there. More recently, it has been the home of entertainers such as Hilary Duff, Tara Strong, Steve Carell, Wayne Knight, Andy Garcia, and Melissa McCarthy.
