Merritt Island Regulations

Short‑term rentals are technically allowed, but Brevard County’s 90‑day minimum outside limited Resort Dwelling zones makes traditional 30‑day Airbnb/Vrbo rentals effectively illegal in most areas, and only narrow coastal resort zones permit STRs under 90 days. Investors face multi‑layer licensing (FL DBPR), county Business Tax Receipt and TDT registration, strict tax obligations, inspections, and 24/7 responsible‑party and parking rules, creating a high compliance and permitting burden.

About Merritt Island

Merritt Island is a census-designated place in Brevard County, Florida, situated on a barrier island along the state's central Atlantic coast. With a population of roughly 34,000 to 36,000 residents, it carries a relaxed, subtropical coastal character shaped by its proximity to the Banana River Lagoon and the Atlantic Ocean. The community is best known as the home of the Kennedy Space Center and serves as a gateway to Florida's Space Coast. It lies approximately 35 to 40 miles east of Orlando, reached via the Beachline Expressway (State Road 528).

The headline draw in and around Merritt Island is the Kennedy Space Center Visitor Complex, located on the island itself just off State Road 405. The complex features astronaut encounters, rocket displays including the Space Shuttle Atlantis exhibit, the Saturn V center, and films chronicling the history of American spaceflight, with bus tours sometimes venturing into restricted areas of the active spaceport. From most points on Merritt Island, the visitor complex is only about a 10 to 20 minute drive.

Sharing much of its acreage with the space center grounds, the Merritt Island National Wildlife Refuge is a vast mosaic of coastal dunes, saltwater marshes, hardwood hammocks, and pine flatwoods. The refuge is one of the most important bird-watching destinations in the United States, hosting an exceptionally high diversity of plants and animals and serving as a wintering ground for migratory waterfowl. Black Point Wildlife Drive, a popular one-way auto tour through impoundments and scrub habitat, lies within a short drive of central Merritt Island.

Just east of the island, the Canaveral National Seashore stretches across miles of undeveloped Atlantic beach and dune system, with access points near Titusville and the southern end of Merritt Island. The seashore offers swimming, surfing, fishing, shelling, and ranger-led programs, and it represents one of the longest stretches of pristine coastline remaining in Florida. From Merritt Island's eastern edge, the seashore's southern access areas are typically within a 20 to 30 minute drive.

Across the Banana River to the south, Cocoa Beach provides a more traditional beach-town experience with a public pier, surf shops, restaurants, and the surfable waves that helped put the region on the map. It is roughly a 15 to 25 minute drive from central Merritt Island via the causeway.

For short-term rental investors, Merritt Island offers a compelling combination of a quiet residential setting with immediate access to one of Florida's most visited tourist attractions, abundant natural beauty, and the beaches of both the Atlantic and the Indian River Lagoon. The Kennedy Space Center draws year-round visitors, while seasonal snowbird traffic and beach-going families supplement demand, making the island a versatile base for vacation rental stays along the Space Coast.
